1. The service
Wisht provides tools to create, manage, and share wishlists and related social features. We may change, suspend, or discontinue features; we will try to give reasonable notice for material adverse changes where practicable.
2. Eligibility
You must be old enough to form a binding contract where you live and meet any minimum age in your jurisdiction (including not using Wisht if you are under 13 in the U.S., unless applicable law allows and we expressly permit it). If you use Wisht on behalf of an organization, you represent that you have authority to bind that organization.
3. Your account
You are responsible for safeguarding your login credentials and for activity under your account. Notify support@wisht.io promptly if you suspect unauthorized access.
4. Your content
You retain rights to content you submit (such as wishlist items, notes, and images). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your content solely to operate, secure, and improve Wisht (including sharing with other users according to features you use).
You represent that you have the rights needed for your content and that it does not violate law or third-party rights. Do not upload unlawful, infringing, harassing, or malicious content.
5. Third-party links and product data
Wisht may display links to third-party stores or retrieve public product information (including via barcode lookup or URL-based import). We do not control third-party sites or databases. Prices, availability, and descriptions may be wrong or outdated. Purchases happen between you and the merchant, not with us.
6. Acceptable use
You agree not to misuse Wisht, including by: attempting to break security; scraping or overloading our systems without permission; using the service to spam, defraud, or harm others; reverse engineering except where law forbids that restriction; or circumventing limits we set.
7. Intellectual property
Wisht’s name, logo, and software are protected by intellectual property laws. Except for the license to your content above, these terms do not grant you rights to our IP.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WISHT AND ITS AFFILIATES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU HAVE NOT PAID US ANYTHING.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
10. Indemnity
You will defend and indemnify Wisht and its affiliates, officers, and employees against third-party claims and costs arising from your content or your violation of these terms or law, to the extent permitted by law.
11. Termination
You may stop using Wisht at any time. We may suspend or terminate access for breach of these terms, risk to the service or others, or legal reasons. Provisions that by nature should survive will survive termination.
12. Governing law and disputes
Unless applicable law requires otherwise, these terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. Courts in that jurisdiction (unless otherwise required) have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any court of competent jurisdiction.
If you are a consumer in the EEA or UK, you may benefit from mandatory protections of your local law; nothing here limits those rights.
13. Changes to these terms
We may update these terms. We will post the updated version on this page and change the effective date. Continued use after changes constitutes acceptance of the revised terms, except where stricter notice or consent is required by law.
